A reminder what happens if you die without a Will

If you have an estate less than £270k and a spouse, your spouse gets everything - your children will not inherit anything

If you have an estate, irrelevant of its size and no spouse but you do have children or grandchildren born to a deceased child then your estate will be divided equally between your children and any grandchildren born to a deceased child

Children include adopted children

If you have an estate, irrelevant of its size and no spouse, no surviving children or grandchildren then the order of inheritance is as follows;

  • Parents
  • Brother and sisters
  • 1/2 brothers and sisters
  • Grandparents
  • Aunts and uncles
  • Cousins
  • 1/2 Aunts and uncles
  • 1/2 cousins
  • The CROWN

If you have an estate over £270k and a spouse and no children or surviving grandchildren - your spouse will inherit everything

If you have an estate over £270k and a spouse and children or surviving grandchildren born to a deceaceed child - your spouse will inherit the first £270k and will have an absolute interest in 50% of the remainder. The other 50% will be divided equally between all surviving children or grandchildren born to a deceased child
