What is included:


The drafting, preparation and establishment of your Property Probate Trust(s) which once registered on the Land Registry will ensure that any property within the Trust(s) is 100% protected should a Settlor (the person setting up the Trust) remarry, preventing sideways disinheritance. The property will also immediately be available to the beneficiaries upon death and will not need to go through probate, significantly reducing the fees of any solicitor conducting probate - and, if the Government decide to introduce them, will avoid the proposed new costly probate fees charges potentially becoming law in the Spring of 2019. 

The assets within the Trust(s) will also not add to beneficiaries’ estates for inheritance tax purposes either due to the way the funds are appointed out of the Trust and the side benefit of these Trusts is that should a Settlor go into care or have care brought into their home after having legally set one of these Trusts up without breaking the deliberate deprivation of assets rules, their property would not need to be sold to fund it.

Our Solicitor then transfers your property from your sole/Joint names into your Property Probate Trust(s).

The land registry is then changed accordingly, legally showing that your property is no longer in your own name but in those of the trustees.
